--- title: "Terms of Service" description: "The agreement between you and Linkbreakers for using linkbreakers.com, the dashboard, the API and every other Linkbreakers service." canonical: "https://linkbreakers.com/terms" --- # Terms of Service > The agreement between you and Linkbreakers for using linkbreakers.com, the dashboard, the API and every other Linkbreakers service. **Linkbreakers** ("Linkbreakers", "we", "us" or "our") operates linkbreakers.com and its subdomains (the "Site"), the Linkbreakers dashboard, the pages your visitors see when they scan a QR code or open a link ("Visitor Pages"), the Linkbreakers API, SDKs, command-line interface and MCP server, the in-product Assistant, and any mobile applications we publish (together, the "Services"). These Terms of Service (the "Terms") are a binding agreement between you and Linkbreakers about your use of the Services. If you use the Services on behalf of a company or other organization, you accept these Terms for it, and "you" means that organization. ## Company information Linkbreakers is a French private company with registration number 531 252 252 (Business ID: 531 252 252 00030, EU VAT number: FR14531252252), located at 30B Rue de l'Or, 33470 Gujan-Mestras, France, and operating since September 24, 2024. ## Accounts and workspaces The Services are intended for businesses and professionals. You must be at least 18 years old, or the age of majority where you live, to create an account. You agree to give accurate information and to keep it up to date. Your data lives in a workspace. You can invite team members to a workspace up to your plan's limit and give each of them a role. You are responsible for everything done in your workspace, including by your team members and with the API tokens you create, and for keeping your password, your tokens and your devices secure. Tell us at [support@linkbreakers.com](mailto:support@linkbreakers.com) if you believe your account has been compromised. You must verify your email address. If no member of a workspace has verified their email within 7 days of sign-up, the dashboard and API of that workspace are paused until an email is verified. Your links, QR codes and Visitor Pages keep working for your visitors in the meantime. An AI agent can create a workspace for you through the API, CLI or MCP server. That workspace belongs to the person who claims it through the link we email them. A workspace that nobody claims within 24 hours is deleted with everything in it. ## Plans and platform credits We offer a Free plan, paid Light and Pro plans, and an Enterprise plan. Each plan comes with monthly allowances, such as platform credits, tracked visits, team members, custom domains, API calls and storage, which are described on our [pricing page](https://linkbreakers.com/pricing). * **Platform credits:** creating links and some other actions consume platform credits. Your plan's monthly credits are used first. You can buy additional credits ("top-ups"), which do not expire and remain available after you change or cancel your plan. If an action fails after consuming credits, those credits are returned automatically. Otherwise, consumed credits are not refunded, including credits used by a link that is later deleted or expires. * **Visit allowance:** scans and visits beyond your plan's monthly allowance are still recorded and your links keep working, but those visits stay locked, hidden and excluded from integrations, until your plan allows more. Upgrading unlocks them. * **Free trial:** we may offer a free trial of a paid plan, for example through a sign-up offer. We show the duration and terms of the trial when we offer it. No payment card is required, and at the end of the trial your workspace moves to the Free plan unless you subscribe. * **Enterprise:** Enterprise plans are agreed with our sales team and billed on usage under a separate order. Where that order differs from these Terms, the order prevails. ## Payment, renewal and cancellation Payments are processed by our payment provider, Stripe. When you subscribe, you agree to pay the subscription fee shown at checkout plus any applicable taxes, which are calculated at checkout. * **Automatic renewal:** subscriptions renew automatically at the end of each billing period until you cancel them. * **Cancellation:** you can cancel at any time from the billing settings of your workspace. When your subscription ends, your workspace moves to the Free plan and its Free allowances apply. Your top-up credits remain available. * **Refunds:** no refunds or credits are provided for partial subscription periods, except where the law requires them. * **Price changes:** we may change our prices. A price change never affects a period you have already paid for; it applies from your next billing period, and we tell you about it in advance. ## Acceptable use You agree not to use the Services to: * link to, or host, phishing pages, malware, scams or any content or activity that is illegal, deceptive or infringes the rights of others; * send spam or other unsolicited messages; * collect personal data from your visitors without a lawful basis, or without telling them what you collect, as required by the laws that apply to you; * interfere with the Services, probe or bypass their security, exceed or work around their rate limits and plan limits, or create workspaces in bulk to avoid them; * attempt to access data of other workspaces. We automatically check link destinations for malicious content. When a destination appears malicious, we usually warn the workspace by email and remove the link if the problem is not resolved within 48 hours. We may remove a link immediately when the risk is high. We may also block email addresses, domains and network addresses used for abuse. ## Teams, clients and reselling You may use the Services for your own business and on behalf of your clients, for example by creating links and QR codes for them or giving them access to your workspace as team members. Reselling the Services, or offering them to third parties under your own brand ("white label"), requires an Enterprise plan. Otherwise, you may not sell, sublicense or rent access to the Services. ## Your content and your visitors' data You keep all rights to the content you put into the Services, such as links, QR code designs, media, forms and workflows ("Your Content"). You give us the right to host, store, process and display Your Content only as needed to provide the Services to you and your visitors. When your visitors scan your QR codes, open your links or fill in your forms, you decide what is collected about them and why. For that data, you act as the data controller and we process it on your behalf, as described in our [Privacy Statement](https://linkbreakers.com/privacy). You are responsible for having a lawful basis to collect it and for informing your visitors. Links can be set to expire. When a link expires, the link and its analytics are deleted permanently and cannot be recovered. ## The Assistant and AI features The Assistant and other AI features send the content needed to answer your request, such as your messages and relevant workspace data, to third-party AI model providers. We route Assistant requests only to providers that do not retain your prompts or use them to train their models. AI output can be wrong or incomplete: review it before you rely on it. ## Ownership and restrictions The Services, and all trademarks, copyrights, database rights and other intellectual property rights in them, belong to Linkbreakers. Except as these Terms allow, you may not copy, modify, translate or make derivative works of the Services or our trademarks, or attempt to extract the source code of the Services. Our SDKs, command-line interface and other components that we publish as open source are governed by their own licenses. ## Changes to the Services We work to make the Services as useful and reliable as possible, and we may add, change or remove features at any time. We will never charge you for a feature without making it clear exactly what you are paying for. ## Suspension and termination You can stop using the Services and delete your workspace at any time. We may suspend or terminate your access, or your subscription, if you breach these Terms, if your use creates a risk for the Services, other users or your visitors, or if the law requires it. Where reasonable, we will tell you first and give you a chance to fix the problem. When a workspace is deleted, its data is deleted as described in our [Privacy Statement](https://linkbreakers.com/privacy). ## Disclaimer and limitation of liability The Services are provided "as is" and "as available". We work to keep them running and accurate, but we do not guarantee that they will be uninterrupted, error-free or always available, and some features depend on third-party services and on your internet connection. To the extent permitted by law, Linkbreakers is not liable for any indirect or consequential loss, such as lost profits, revenue or data, and our total liability for any claim related to the Services is limited to the amount you paid us in the 12 months before the event that gave rise to the claim. Nothing in these Terms limits liability that cannot be limited by law, such as liability for gross negligence or willful misconduct, or the rights consumers have under mandatory law. ## Changes to these Terms We may update these Terms from time to time. We post the new Terms on this page and update the date above, and we notify you by email or in the dashboard before material changes take effect. If you keep using the Services after the changes take effect, you accept the new Terms. ## Governing law These Terms are governed by French law.
